1. Copyright Law and Creative Quotations:
Copyright laws are designed to advance the progress of knowledge by giving authors an economic incentive to create new works. Authors and their heirs are automatically granted the exclusive right to reproduce, adapt, perform and display their works for at least fifty (and usually more) years. However, a strict enforcement of "copyrights" would actually hinder, rather than promote, the growth of knowledge. The work of a researcher often depends on the ability to refer to and quote from a prior work of another scholars' work, and it would simply be too time-consuming to "bargain" with each copyright owner for permission to quote from or refer to prior works.
To get around this problem, the "fair use" clause was designed to permit a researcher to make limited use of an author's work without asking permission. All authors and other copyright owners are deemed to give their automatic consent to the fair use of their work by others. The fair use privilege is perhaps the most significant limitation on a copyright owner's exclusive rights. However, determining whether the fair use privilege applies in any given situation is not a clear-cut process.
For example, posting a one-sentence quotation on publicly accessible webpages from an interview with a movie star is quite different than posting a carefully crafted (and copyrighted) one-sentence quotation from a creative writer who makes her or his living from selling clever slogans. A good test to determine "fair use" of quotations is, therefore, to ask, "Does the author depend on income generated specifically from this quotation as part of their livelihood?" If the answer is yes, then you should seek permission to use the quotation.
The Creative Quotations website is designed to advance the progress of knowledge in the areas of creative thinking, working and living. To this end, Creative Quotations relies extensively on the "fair use" clause to reproduce carefully selected quotations from thousands of authors without seeking individual permission. At the same time, Creative Quotations is one of the few websites on the Internet that strives to document the original source or a published source for each quotation.
If you happen to be one of the famous people featured at Creative Quotations, congratulations! I hope that you will accept this modest public recognition of your work in the spirit that it is intended. If you would like CQ to to create a link from your CQ webpage to your homepage, just let us know at please-add-my-link@bemorecreative.com. If, on the other hand, you think that CQ's reproduction of your work infringes on your copyright for that material, just let us know, and we will immediately remove the quotation(s) (or your entire webpage) from Creative Quotations.
By the way, Creative Quotations is also copyrighted. While
CQ can not copyright the quotations themselves, we can copyright a
collection of quotations and a particular presentation format. The format
of Creative quotations -- five carefully selected quotations and graphics
linked to five components of creativity -- is unique and copyrightable.
This is the “material” that is referred to below in the general terms of
use.
2. General Terms of Use for Bemorecreative.com Materials:
This site contains intellectual property owned by Baertracks Creative Impulses (referred to herein simply as Baertracks). No material from this site or from Creative Quotations (TM) may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, without the prior written permission of Baertracks. You may, however, download one copy of the materials on any single computer for your personal, non-commercial home use only, provided you keep intact all copyright and other proprietary notices.
If you download software from Baertracks, the software, including any files, images incorporated in or generated by the software, and data accompanying the software (collectively, the "Software") are licensed to you by Baertracks. Baertracks does not transfer title to the Software to you. You own the medium on which the Software is recorded, but Baertracks retains full and complete title to the Software and all intellectual property rights therein. You may not redistribute or sell the Software.
This site is controlled and operated by Baertracks from its office within the State of Virginia, USA. This agreement shall be governed by and construed in accordance with the laws of the State of Virginia.
